Most people think being named as a successor trustee of a loved one's living trust is simply an honor.

 

In reality, it can become one of the most stressful, emotionally difficult, and legally risky responsibilities a family member will ever face--if it's not handled properly. 

 

Unfortunately, many successor trustees are completely unprepared for the job when the time comes.

 

After the death of a parent, spouse, or loved one, a trustee may suddenly find themselves responsible for:

 

  • handling finances,
  • managing real estate,
  • dealing with beneficiaries,
  • protecting assets,
  • paying bills and taxes,
  • and carrying out legal responsibilities they may not fully understand.

All while trying to cope with grief and family emotions.

 

What many families do not realize is that some of the biggest trustee mistakes happen within the first few weeks after death.

 

We have seen trustees accidentally create problems by:

 

  • distributing assets too quickly,
  • failing to secure important documents,
  • mishandling communication with family members,
  • neglecting required legal steps,
  • or simply failing to keep good records.

Even well-meaning trustees can quickly become overwhelmed. 

And when confusion or misunderstandings arise, family conflict often follows.
