What is the difference between probate and trust administration?

Probate is a court-supervised legal process for transferring assets after death, while trust administration is usually handled privately by the successor trustee without ongoing court involvement.

Trust administration is generally faster, more confidential, and less expensive than probate, particularly in California where probate fees are based on the gross value of the estate rather than the net equity. A properly structured trust can also provide better continuity for businesses, investments, and long-term family planning.
